1. About Tonomo
Tonomo Serviços Digitais Ltda. operates a marketplace that connects consumers and service providers. These Terms govern all interactions with our website, apps and APIs.
2. Key definitions
Platform, Provider, Client, Lead and User as described in the Portuguese version apply equally here.
3. Acceptance and updates
By accessing or creating an account you agree to these Terms and to the Privacy Policy. Material updates will be shared via e-mail, dashboard or banners.
4. Eligibility and accounts
Only individuals 18+ with legal capacity may use the Platform. Providers must hold all licenses and permits required by their profession. Users are responsible for the accuracy of information and for safeguarding their credentials. Tonomo may suspend or terminate accounts suspected of fraud, spam or policy violations.
5. Scope of the Platform
We offer tools for discovering providers, exchanging leads and messages, viewing dashboards, and tracking analytics. Tonomo does not hire providers, guarantee services, handle payments or become a party to agreements between users.
6. Provider responsibilities
Maintain accurate profiles, respond to leads transparently, comply with applicable laws and handle client data according to the Privacy Policy.
7. Client responsibilities
Submit truthful requests, negotiate directly with providers, respect confidentiality of shared contact info and review providers based on real experiences.
8. Forbidden conduct
Illegal content, harassment, impersonation, scraping, reverse engineering, selling accounts/leads, distributing malware or using platform data to build a competing product are strictly forbidden.
9. Monitoring and analytics
Leads, attachments and messages exchanged within the Platform may be monitored for security, anti-fraud and product improvement purposes. External conversations (e.g., WhatsApp) are outside our scope.
10. Fees
Access is currently free. We may introduce paid plans or service fees upon prior notice.
11. Content license
Users retain ownership of their content but grant Tonomo a worldwide, royalty-free license to use, reproduce, adapt and display it to operate and promote the Platform.
12. Metrics, marketing and cookies
We collect usage statistics (traffic origin, geography, engagement) to power dashboards, highlight providers and assess campaigns. Analytics identifiers (including Google Analytics and our first-party Analytics Beacon) are only activated after consent via the cookie banner, and preferences can be revisited at any time through the “Cookie preferences” link in the footer. Promotional e-mails always include an unsubscribe link.
13. Intellectual property
The Tonomo brand, code, design and databases remain our property or that of our licensors. No user may copy, distribute or create derivative works without written permission.
14. Availability
The Platform is provided “as is”. We do not guarantee uninterrupted service or freedom from errors. Maintenance windows or feature changes may occur at any time.
15. Liability and disclaimers
Tonomo is not responsible for agreements or services performed by providers. To the extent permitted by law, our liability is limited to the amounts paid to Tonomo in the twelve (12) months preceding the event that generated the claim.
16. Indemnity
Users agree to indemnify and hold Tonomo harmless for claims arising from misuse, breach of these Terms or violation of third-party rights.
17. Suspension and termination
We may suspend or terminate accounts for policy violations, fraud, legal requests or to protect the community. Users may request deletion; residual data may remain as required by law.
18. Data protection
Personal data is processed in accordance with the Privacy Policy, which forms part of these Terms.
19. Modifications
We may change these Terms at any time. The version in force is identified by the “Last updated” date.
20. Governing law and venue
Brazilian law governs these Terms. The courts of São Paulo/SP, Brazil, shall have jurisdiction, unless consumer protection rules determine otherwise.
